Terms & Conditions

These Terms and Conditions apply to every order placed on prismellea.shop. Please read them before ordering. By placing an order you agree to them. Nothing in these Terms affects the statutory rights you have as a consumer.

Who we are

PRISMELLEA is a brand operated by AsianBeautyWholesale (Hong Kong) Limited, a company incorporated in Hong Kong, registered office 5/F, KC100, 100 Kwai Cheong Road, Kwai Chung, New Territories, Hong Kong (“we”, “us”). What we sell

We sell makeup bags, toiletry bags, vanity organisers, brush holders and spa headbands and hair wraps to consumers. We do not sell cosmetics or skincare products, and bottles, jars, brushes and other items shown in our images are for styling only and are not included unless the product description says so.

We describe each product as accurately as we can, including materials, dimensions and what is included. Images illustrate the design; colours can look slightly different on different screens. We do not describe our products as waterproof.

Prices and currencies

  • Prices are shown in the currency you select: US dollars (USD), euros (EUR), pounds sterling (GBP), Danish kroner (DKK) or Swedish kronor (SEK). You pay in the currency shown at checkout. Prices in currencies other than USD are converted at rates we set and review regularly; the price shown at checkout is the price you pay.
  • Prices include all taxes we are required to charge. Hong Kong does not levy sales tax on our goods. Import duties, taxes and fees charged by your country are not included and are payable by you; see Delivery & Duties.
  • Delivery charges are shown in the cart and at checkout before you pay.
  • We do not use countdown timers, artificial scarcity or reference prices. If a price on our site is obviously wrong, we will tell you before dispatch and you can confirm the order at the correct price or cancel it for a full refund.

Placing an order

  1. Add items to your cart, go to checkout and enter your details.
  2. Check your order and correct any mistakes before you press the button to place your order and pay.
  3. We send an email acknowledging your order. The contract between us is formed when we send that order confirmation email.

We may decline an order before dispatch, for example if an item is unavailable, we cannot deliver to your address, or we suspect fraud. If we do, we refund any payment in full.

Payment

The payment methods available are shown at checkout. Payments are processed by our payment service providers, which are certified to the Payment Card Industry Data Security Standard (PCI DSS). Card details are entered on the provider’s secure form and are never stored on our servers. Your payment is taken when you place your order. Our site uses HTTPS encryption throughout.

Delivery

We deliver to the countries listed on our Delivery & Duties page, at the rates and estimated times stated there. Ownership of and risk in the goods pass to you on delivery.

Returns, cancellations and refunds

You can return items under our 30-day returns promise. If you are in the EU, the UK or the EEA, you also have a statutory 14-day right to cancel. Both are explained, together with the model withdrawal form, on our Returns & Refunds page, which forms part of these Terms.

Your rights under Hong Kong law

Under the Sale of Goods Ordinance (Cap. 26), goods we sell must match the description we gave them, be of merchantable quality, and be fit for any particular purpose you made known to us before buying. If they are not, you may reject them and claim a refund, or claim damages.

Under the Control of Exemption Clauses Ordinance (Cap. 71), we cannot exclude or limit these obligations when selling to a consumer, and nothing on this site attempts to.

If you live outside Hong Kong, the mandatory consumer-protection rules of your country of residence, such as the legal guarantee of conformity in the EU or the Consumer Rights Act 2015 in the UK, also apply to you.

Our liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable, or for business losses. We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for breach of your statutory rights as a consumer.

Intellectual property

The PRISMELLEA name, logo, product designs, images and text on this site belong to us or our licensors. You may not copy or use them for commercial purposes without our written permission.

Personal data

We use your personal data as described in our Privacy Policy and Personal Information Collection Statement.

If something goes wrong

Contact us first at support@prismellea.shop. We aim to resolve every complaint within 14 days.

If we cannot resolve it and you are in Hong Kong, the Consumer Council offers a free complaint and conciliation service. The Consumer Council is not a regulator and cannot make binding decisions. For claims up to HK$75,000 you may also use the Small Claims Tribunal, which is designed to be used without a lawyer.

If you live outside Hong Kong, you can contact the consumer advice body in your own country, and the mandatory consumer-protection rules of your country of residence continue to apply to you.

Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.

The Hong Kong courts have non-exclusive jurisdiction. Nothing in this clause affects your right, as a consumer, to bring proceedings in the courts of the country where you are resident, or to rely on mandatory consumer-protection rules of that country.

Changes to these Terms

We may update these Terms from time to time. The version that applies to your order is the one shown on this page when you placed it. If these Terms are translated, the translation is provided for convenience; where there is a difference, the version most favourable to you applies.
